Tpch Following Up On Testing Effort For Compliance With Metals Ban - State Officials To Re-Evaluate Status Of Wax-Filled Candle Holers

TPCH voted 2004 to make permanent model provisions exempting glass & ceramic packaging from its model packaging legislation. To qualify for the exemption, a glass or ceramic package producer must demonstrate that its ware would pass a TCLP test after preparing a sample using ASTM C1606-04 method TCLP results must not exceed 1.0 ppm/cadmium, 5.0 ppm/lead, & 5.0 ppm/hexavalent chromium. TPCH has indicated that it will reevaluate whether wax-filled candle holders are subject to the model packaging legislation based on whether they can be construed to be a "package". TPCH reaffirmed that candle holders where a candle is placed in a glass jar are not a "package" & therefore subject to the model legislation by their definition; however, the group is reexamining candles where wax has been poured into an often-decorated jar. SGCD believes that such a candle is a "product"not a "package," and is working with the TPCH state members as they consider this definition.
