California Proposition 65: In addition to federal safety standards monitored by the US FDA, a California law known as Proposition 65 mandates warnings for products that allegedly expose consumers to any one of hundreds of chemicals including lead and cadmium. Starting in 2002, and continuing through 2005, a private attorney has filed around 100 notices of Prop 65 violations against importers, retailers restaurants and manufacturers in California related to alleged lead exposure from the outside non-food-contact surfaces of glass and ceramic ware. During this period, no actions have been brought by the State of California. This article examines the recent situation.
